U.S. Court of Appeals Grants Stay on Implementation of WOTUS Nationwide

This morning (Friday, October 9, 2015), the U.S. Court of Appeals for the 6th Circuit granted a nationwide stay against the Waters of the United States (WOTUS) rule finalized by the Environmental Protection Agency and the U.S. Army Corps of Engineers in May.

The appellate court said that the 18 states challenging the new standards were unlikely to face immediate irreparable harm from the rule, but there was also no evidence that the nation's waters would suffer "imminent injury" if the regulation was put on hold.  (Read Story)

AMC sent a letter last week to Attorney General Lori Swanson encouraging her to join the other states in challenging the standards, but no action had been taken specifically by Minnesota by the time of this morning’s ruling.  Minnesota counties are concerned the new rule broadens the definition of waters regulated under the Clean Water Act, potentially increasing the time and cost it will take to complete county infrastructure projects.
